Terms of Use

1. These terms

These terms are an agreement between you and Hashem Mazen Wahed of Maryland, USA, who runs Rosalind (“we”, “us”). By creating an account or using Rosalind, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use Rosalind.

2. Who can use Rosalind

• You must be 13 or older.
• If you are under 18, a parent or guardian must confirm that you may use Rosalind, and by doing so they agree to these terms for you and are responsible for your use of it.
• Videos must not show a rider under 13 as the rider being coached.
• Rosalind is currently in private testing, and we decide who is invited.

3. Riding safety: please read this

Horse riding is a risky activity, and Rosalind is a tool, not an instructor. Its coaching comes from an AI looking at silhouettes of a short clip, and it can be wrong, incomplete or unsuitable for you, your horse or your discipline. It cannot see your fitness, your injuries, your horse’s training or temperament, your tack or the conditions you ride in.

• Use the coaching as information to think about, not as instructions you must follow.
• Try changes gradually, in a safe place, and stop if something feels wrong for you or your horse.
• Work with a qualified riding instructor, especially before changing anything that affects your security in the saddle.
• Always wear appropriate safety equipment.

You are responsible for how you ride and for your horse’s welfare. To the extent the law allows, we are not responsible for injury, loss or damage that results from acting on Rosalind’s coaching.

4. Your account and your key

• Keep your sign-in (passkey or password) secure, and tell us at [email protected] if you think someone else has used your account.
• Your stored videos are encrypted with your own key, which only your passkey, your password or your recovery code can unlock. We cannot reset or recover it. If you lose all of them, your stored videos can’t be opened by anyone, and we will delete them. Download anything you want to keep.
• Give us accurate information, including your date of birth.

5. Your videos

You keep all your rights in the videos you upload and in your coaching videos. You give us permission to store and process your videos only as needed to provide Rosalind to you: to analyse them, make silhouette frames for our AI coach, make your coaching results and video, and keep them for the time you choose. We don’t use your videos for anything else, and we don’t train AI models on them.

When you upload a video, you confirm that:

• you have the right to upload it, and the rider being coached is you, or someone who has agreed (or whose parent or guardian has agreed);
• you have taken reasonable care about other people who appear in it, and asked them where you can;
• it doesn’t contain anything illegal, harmful or unrelated to riding.

6. Sharing your coaching video

Your coaching video is yours to download and share. It shows a small Rosalind mark in the corner and a closing card with our name; please don’t remove them if you post the video publicly. Once you share or post a video, it is outside Rosalind, and what happens to it is your responsibility.

7. Acceptable use

Please don’t:

• upload videos of other people without their permission, or use Rosalind to watch or track someone;
• try to get around our security, our limits or our encryption, or access other people’s accounts;
• copy, resell or reverse engineer Rosalind, or use it to build a competing product;
• overload the service, for example with automated uploads;
• use Rosalind for anything illegal.

We may suspend or close accounts that break these rules, and delete videos that do. Because stored videos are encrypted, we can’t look at them; we act on what we are told, for example in a report to [email protected].

8. Rosalind itself

Rosalind’s software, design, coaching method and brand belong to us. These terms let you use Rosalind for your own riding; they don’t give you any other rights in it. If you send us feedback or ideas, we may use them without owing you anything.

9. Price

Rosalind is free during private testing. If we introduce paid plans, we will tell you the price and what it includes before you are charged anything, and you can decide then.

10. Changes and availability

Rosalind is in testing and will change. We may add, change or remove features, and the service may sometimes be unavailable. If we change these terms in a way that affects you, we will email account holders before the change takes effect; using Rosalind after that means you accept the new terms.

11. Ending your use

You can stop using Rosalind and delete your account at any time; that deletes your videos and results. We may end or suspend your access if you break these terms or if we stop offering Rosalind; where we can, we’ll give you notice so you can download your videos first.

12. Disclaimers and limits

Rosalind is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be accurate, uninterrupted or suitable for any particular purpose, and we are not liable for indirect or consequential losses, or for loss of data you could have downloaded. To the extent the law allows, our total liability to you for any claim about Rosalind is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Nothing in these terms limits liability that the law does not allow us to limit, or your rights as a consumer that can’t be waived.

13. Law and disputes

These terms are governed by the laws of the State of Maryland, USA. If there’s a problem, please email us first; most things can be sorted out quickly. Any dispute that can’t be resolved goes to the state or federal courts in Maryland, unless the law where you live gives you the right to bring it in your local courts.
